PDIP Warning Airin Rachmi Diani, Jangan Pura-pura Bego Dalam Kasus Bintaro Mal Xchange

*JAKARTA,* PDI Perjuangan meminta Wali Kota Tangerang Selatan Airin Rachmi Diani tidak berpura-pura tak paham terhadap kasus pencaplokan lahan milik rakyat yang dilakukan PT Jaya Real Property, Tbk.

Kader PDI Perjuangan Provinsi Banten Edmond Jamlean mengatakan PT JRP mencaplok tanah seluas 11.320 m2 milik Alin bin Embing dengan ahli waris Yatmi.

“Lahan hasil mencaplok itu diklaim PT JRP sebagai bagian dari Bintaro Mal Xchange,” kata Edmond Jamlean, Sabtu (15/8/2020).

Edmon menceritakan proses pencaplokan tanah tersebut di mana jabatan Wali Kota Tangsel dipegang oleh Airin Rachmi Diani.

“Airin menjabat sebagai Wali Kota Tangsel sejak April 2011 dan sampai sekarang,” jelas Edmond.

Kata Edmond, pembangunan Bintaro Mal Xchange dimulai pada 2010 dan mulai beroperasi tahun 2013 atau awal 2014. Anehnya, sertifikat HGB-nya yang bernomor 2168/Pondok Jaya atas nama PT Jaya Real Property, Tbk diterbitkan pada 9 Oktober 2017.

Lebih detail lagi dijelaskannya,    penerbitan HGB tersebut sesuai dengan Surat Ukur No. 369/Pondok Jaya/2016 yang dikeluarkan pada 3 Mei 2016 dan berdasarkan SK Kepala Kantor Wilayah BPN Provinsi Banten No. 107/HGB/BPN.36/2017 Tanggal 26 September 2017.

Keterlibatan Airin dipertegas saat digelar pertemuan yang melibatkan stake holder-stake holder atau instansi-instansi terkait di lingkungan Pemkot Tangsel dan Pemprov Banten pada 11 Agustus 2020 di kantor Inspektorat Jenderal Kementerian Dalam Negeri (Kemendagri).

Hasil pertemuan itu mengungkapkan bahwa PT JRP mengajukan IMB kepada Pemkot Tangsel pada 2017, jauh setelah Bintaro Mal Xchange dibangun.

“Selanjutnya baru dikeluarkan Izin Prinsip atau Izin Peruntukan Penggunaan Tanah (IIPPT) tahun 2018. Setahun berikutnya, 2019, Pemkot Tangsel menerbitkan IMB. Fakta ini sangat terang benderang sekali adanya mufakat jahat terhadap keluarga Alin bin Embing,” tegas Edmond.

Bukti-bukti lainnya telah terjadi pencaplokan tanah milik Alin bin Embing diperkuat dengan surat dari Kelurahan Pondok Jaya No. 973/13-Pem tanggal 18 Januari 2018.

Dalam surat tersebut Kelurahan Pondok Jaya menegaskan bahwa dasar mutasi yang pernah ada tidak terkait dengan nama-nams para ahli waris sesuai yang ditetapkan Pengadilan Agama (PA) Tigaraksa.

“Diperkuat lagi dengan surat No. 593/89-PPAT/2018 Tanggal 5 Maret 2018 yang dikeluarkan PPATS Kecamatan Ciledug. Isinya menyatakan bahwa tidak ditemukan arsip Letter C 428 milik Alin bin Embing dalam daftar mutasi atau proses jual beli,” tuturnya.

Pada 10 Juli 2018 Kelurahan Pondok Jaya mempertegas melalui surat No. 973/109-Pem yang menjelaskan bahwa mutasi yang tercatat tidak terkait dengan nama para ahli waris yang dikeluarkan PA Tigaraksa.

Edmond dengan tegas menyatakan sesuai amanat partai dan sejalan dengan perintah Presiden Joko Widodo yang pro terhadap rakyat, ia dan seluruh kader PDIP di Pemkot Tangsel dan Provinsi Banten akan mengawal proses pengembalian hak tanah kepada Yatmi, ahli waris Alin bin Embing.

Sementara itu, kuasa ahli waris penuh Poly Betaubun mengatakan akan ada pertemuan kembali di kantor Itjen Kemendagri.

“Selain ahli waris, yang hadir di pertemuan 11 September nanti sama persis di pertemuan pertama yaitu Inspektur Daerah Provinsi Banten, Inspektur Daerah Kota Tangsel, Dinas Penanaman Modal Pelayanan Terpadu Satu Pintu (PTSP) Kota Tangsel dan Bagian Hukum Setda Kota Tangsel,” papar Poly.

Hadir juga nanti, Kepala Kantor ATR/BPN Tangsel, Camat Pondok Aren, Lurah Pondok Jaya, Lurah Pondok Aren, dan mantan Lurah Pondok Jaya Achmad Saichu.

Poly mengucapkan terima kasih kepada kader PDIP, Edmond Jamlean, yang membela dan peduli terhadap kepentingan rakyat kecil seperti Yatmi.

“Kepada ahli waris, Bang Edmond berjanji jika hak ahli waris terabaikan akan membawa kasus ini ke DPP, bahkan kalau perlu ke DPR RI,” ungkap Poly.

Kasus pencaplokan tanah ini, selain diadukan ke Mendagri Tito Karnavian, ahli waris juga sudah mengadukan ke Presiden Jokowi, Kepala KSP Moeldoko, dan Menteri ATR/Kepala BPN Sofyan Djalil. (*)
