Peraturan pemerintah pengganti undang undang republik indonesia nomor 1 tahun 2015 tentang perubahan atas Undang Undang Nomor 30 tahun 2002 tentang komisi pemberantasan tindak pidana korupsiInstruksi presiden republik indonesia nomor 1 tahun 2010 tentang percepatan pelaksanaan prioritas pembangunan nasional.
Instruksi Menteri dalam Negeri No 8 Tahun 1990 tentang Pembinaan Lembaga Swadaya Masyarakat. Danperaturan pemerintah (PP) No. 61 Tahun 2010 tentang pelaksanaan UU KIP serta Permendagri No. 3 tahun 2017 tentang pedoman pengelolaan pelayanan informasi dan dokumentasi termasuk biaya pengadaannya LSM dan wartawan dalam menjalankan fungsinya sebagai kontrol sosial dijamin uu.
Bahkan lembaga hukum pun bisa di kontrol oleh lsm dan wartawan.Makan, fungsi lsm dan wartawan tidak ada satupun yang menghalanginya. Kontrol penegak hukum/Inspektorat tidak bisa menghalangi tugas lsm dan wartawan. “Mari bekerja nyata dan wujudkan ke transparan.
“Untuk itu para kepala desa gunakanlah dana ADD dan DD sebagai mana semestinya, untuk memajukan pembangunan desa Dan juga berilah Informasi sebagaimana mestinya kepada LSM dan Wartawan, agar dapat disampaikan kepada masyarakat luas demi terwujudnya cita-cita Negara dalam mewujudkan Informasi yang transparansi akan kebijakan, keputusan, dan penggunaan anggaran kepada masyarakat luas, tidak mesti hatus takut dalam memberikan Informasi kepada LSM dan WartawanBerdasarkan Pasal 1 angka 1 Undang-Undang No. 40 Tahun 1999 tentang Pers (“UU Pers”), pers adalah lembaga sosial dan wahana komunikasi massa yang melaksanakan kegiatan jurnalistik meliputi mencari, memperoleh, memiliki, menyimpan, mengolah, dan menyampaikan informasi baik dalam bentuk tulisan, suara, gambar, suara dan gambar, serta data dan grafik maupun dalam bentuk lainnya dengan menggunakan media cetak, media elektronik, dan segala jenis uraian yang tersedia.
Pada dasarnya pers mempunyai kemerdekaan dalam menjalankan profesinya. Untuk menjamin kemerdekaan pers, pers nasional mempunyai hal mencari, memperoleh, dan menyebarluaskan gagasan dan informasi (Pasal 4 ayat (3) UU Pers).
Ini berarti pers tidak dapat dilarang untuk menyebarkan suatu berita atau informasi jika memang hal tersebut berguna untuk kepentingan publik.Kemerdekaan pers tersebut juga dikatakan dalam Kode Etik Jurnalistik. Kemerdekaan pers adalah sarana masyarakat untuk memperoleh informasi dan berkomunikasi, guna memenuhi kebutuhan hakiki dan meningkatkan kualitas kehidupan manusia. Akan tetapi, dalam mewujudkan kemerdekaan pers itu, wartawan Indonesia juga menyadari adanya kepentingan bangsa, tanggung jawab sosial, keberagaman masyarakat, dan norma-norma agama.
Ini berarti kemerdekaan pers itu tidak tanpa batas. Ada hal-hal yang membatasinya yang perlu diperhatikan oleh pers dalam memuat berita. Pers nasional berkewajiban memberitakan peristiwa dan opini dengan menghormati norma-norma agama dan rasa kesusilaan masyarakat serta asas praduga tak bersalah (Pasal 5 ayat (1) UU Pers).Tetap mengacu pada Asas praduga tak bersalah, ” Dalam UU Nomor 14/1970 tentang Pokok Kehakiman yang diperbarui terakhir jadi UU Nomor 48/2009 Pasal 8 Ayat (1).
Asas tersebut ditegaskan lagi dalam UU Nomor 8/1981 tentang KUHAP pada Penjelasan Umum Angka 3. Itu diperkuat lagi dalam UU Nomor 39/1999 tentang Hak Asasi Manusia Pasal 18 Ayat (1)UU Pers mewajibkan pers untuk menghormati asas praduga tak bersalah, dalam memberitakan peristiwa dan opini.Perlu Anda ketahui bahwa wartawan Indonesia memiliki hak tolak untuk melindungi narasumber yang tidak bersedia diketahui identitas maupun keberadaannya, menghargai ketentuan embargo, informasi latar belakang, danoff the record sesuai dengan kesepakatan (Pasal 7 Kode Etik Jurnalistik).
