Mata Pisau Humum Bagi Koruptor : Putusan Pengadilan Tinggi Riau Meringankan Hukuman Koruptor

Putusan Pengadilan Tinggi (PT) Pekanbaru yang mengurangi hukuman terdakwa korupsi, Bupati Bengkalis nonaktif, Amril Mukminin menjadi 4 tahun penjara dan denda Rp300 juta, Jumat (22/01/2021) lalu, membuat LSM Komunitas Pemberantas Korupsi, Provinsi Riau di Pekanbaru gerah dan berharap agar Komisi Pemberantasan Korupsi (KPK) segera mengajukan upaya hukum kasasi ke Mahkamah Agung (MA).

 

“Kami mengharapkan Komisi Pemberantasan Korupsi (KPK) segera mengajukan upaya hukum kasasi ke Mahkamah Agung,” ujar Ketua DPW LSM Komunitas Pemberantas Korupsi, Provinsi Riau, Juliandi SH melalui keterangannya di Pekanbaru, Minggu (24/01/2021).

Menurutnya, pengurangan hukuman di tingkat banding terhadap Bupati Bengkalis nonaktif, Amri Mukminin tersebut benar-benar mencoreng rasa keadilan di tengah publik dan masyarakat. Bahkan kata dia, putusan yang dijatuhkan Pengadilan Tinggi Pekanbaru itu jauh lebih rendah dibandingkan putusan terhadap mantan Kepala Cabang Bank Riau Kepri Pangkalan Kerinci-Pelalawan (Faisal Syamsuri-red) yang korupsinya hanya sebesar Rp1 milliar 163 juta rupiah.

 

“Mantan kepala cabang Bank Riau Kepri Pangkalan Kerinci-Pelalawan itu dijatuhi hukuman (vonis) 7 tahun penjara dan subsider Rp300 juta karena terbukti merugikan negara Rp1,3 miliar. Sedangkan Amril Mukminin berstatus sebagai mantan wakil rakyat atau anggota DPRD dan status terakhirnya sebagai Bupati di negeri junjungan Kabupaten Bengkalis, menerima suap lebih dari Rp5 miliar lebih, namun hanya diganjar dengan hukuman 4 tahun penjara. Aneh kan? tanya Juliandi SH dengan nada kesal.

 

Selain itu, kata Juliandi, vonis terhadap Bupati nonaktif Amril Mukminin tersebut sangat tidak berkeadilan jika dibandingkan dengan vonis-vonis terhadap beberapa aktivis dan Wartawan/Jurnalistik anti korupsi yang dikriminalisasi selama ini, tuturnya.

 

Diucapkan Juliandi, seharusnya vonis yang dijatuhkan oleh Pengadilan Tinggi Pekanbaru itu bisa lebih berat dibandingkan dengan putusan di tingkat pertama pada Pengadilan Negeri (PN) Pekanbaru. Dengan kondisi penerapan hukum di pengadilan seperti ini, cita-cita negeri untuk lepas dari kejahatan tindak pidana korupsi atau KKN tidak bakal tercapai, ujarnya

 

Diketahui sebelumnya, Senin (09/11/2020), mantan Bupati Bengkalis, Amril Mukminin terdakwa kasus suap dana proyek pekerjaan peningkatan jalan Duri-Sei Pakning yang dibangun secara multi years atau tahun jamak pada tahun 2017-2019 dengan biaya anggaran senilai Rp498.645.596,000 atau Rp498,6 miliar lebih, divonis enam tahun penjara oleh majelis hakim Pengadilan Negeri Pekanbaru. Vonis tersebut sama dengan tuntutan Jaksa Penuntut Umum (JPU) KPK yang meminta hakim menghukum terdakwa enam tahun penjara.

 

“Berdasarkan keterangan dan bukti selama persidangan, terdakwa Amril Mukminin terbukti melakukan korupsi dan memvonis terdakwa dengan 6 tahun penjara,” kata Ketua Majelis Hakim Pengadilan Negeri Pekanbaru, Lilin Herlina, Senin (09/11/2020).

 

Dalam amar putusannya, majelis hakim menyatakan terdakwa terbukti melanggar Pasal 12 huruf a undang-undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana diubah dengan undang-undang No. 20 Tahun 2001 tentang Perubahan atas UU 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi juncto Pasal 64 Ayat (1) KUHPidana.

 

Dalam dakwaan, Amril terbukti menerima uang suap dalam proyek jalan Duri-Sei Pakning, Bengkalis dari PT Citra Gading Asritama (PT. CGA) senilai Rp5,2 miliar. Majelis hakim pun menilai, terdakwa sebagai panutan malah tidak mendukung upaya pemerintah dalam memberantas korupsi.

 

Selain itu, terdakwa juga diwajibkan membayar denda sebesar Rp500 juta atau bisa diganti kurungan 6 bulan penjara. Bukan itu saja, majelis hakim juga mencabut hak politik Amril Mukminin sebagai politisi Golkar selama tiga tahun.

 

Uang suap tersebut, juga disebut ada mengalir ke rekening istrinya Amril Mukminin yakni Kasmarni yang saat itu menjabat Camat Mandau Kabupaten Bengkalis. Namun dalam persidangan, Kasmarni selaku isteri Bupati Amril Mukminin, batal memberikan keterangan, karena dia mempunyai hubungan keluarga dengan terdakwa (suami-isteri).

 

Untuk diketahui, Kasmarni saat ini merupakan Bupati Bengkalis terpilih pada Pilkada serentak tanggal 09 Desember 2020 lalu. bagaimana antirasuah atau KPK menyikapi putusan hakim Pengadilan Tinggi Pekanbaru yang mengurangi hukuman Amril Mukminin dari 6 tahun menjadi 4 tahun penjara, maupun status dugaan gratifikasi berupa nominal uang hingga mengalir ke rekening istrinya Amril Mukminin, sebagaimana termuat dalam dakwaan JPU KPK, Nomor 42/TUT.01.04/24/06/2020 tanggal 17 Juni 2020 dan keterangan lainnya dalam berkas perkara, No. BP/41/ DIK.02.00/23/05/2020, ditunggu publik.***(red)
