Nasabah yang telah berinvestasi senilai 1,5 Milyar bernama DS.warga kota Pekanbaru melalui kuasa hukumnya akhirnya memastikan telah mendaftarkan gugatan di Pengadilan Negeri Pekanbaru 04/01/2022.
Setidaknya ada 2 tim kuasa dilibatkan dalam perkara tersebut, kuasa hukum litigasi ditangani oleh Kantor Hukum Dan Advokat Andi Lawyer & Partner yang berperan dalam pendampingan dan pembelaan hukum nasabah.
Sedangkan Lembaga Pemberdayaan atau organisasi tri power yang memiliki kelengkapan Organisasi sebagai Pemberdayaan atau Kontrol Independent, Bantuan Hukum (Bankum) dan Media Publikasi berperan sebagai kuasa non litigasi sebagai pendamping dan mewakili nasabah sesuai lingkup peran yang disandangnya telah siap memberikan kontribusi dalam mengungkap fakta yang terjadi dalam kasus ini.
Saat dikonfirmasi oleh wartawan, Pimpinan Kuasa non litigasi yang akrab disapa Rudy membenarkan hal tersebut “ya benar dari tim kuasa litigasi/pengacara kita telah resmi daftarkan gugatan terhadap PT. Narada Aset Menejemen (NAM). Sebelumnya kita sebagai dalam posisi non litigasi telah melakukan cross ricek. Kita sudah melakukan pertemuan dengan pak Daniel Mok sebagai yang mengaku pimpinan di wilayah Pekanbaru Riau, dan beliau juga termasuk memberikan penjelasan tentang untung, fee kepada “D” yang justru tidak terealisasi sesuai yang dijanjikan “jelasnya”
Bahkan pak Daniel Mok mengaku dalam pembicaraan tersebut atas adanya permasalahan dalam perusahaan PT. Narada Aset Menejemen tersebut, tentunya jauh sebelum disuspensi. Artinya sudah ada gejala kebangkrutan tetapi kenapa masih rekrut dengan dalil manis?… sehingga pak Daniel hanya jawab kalau dia sebagai pelaksana tugas dari pimpinan pusat (atasan), bahkan dalam dan diluar pertemuan pak Daniel Mok yang selalu menyembunyikan identitas dan jati dirinya tersebut selalu mengelak atas pertanyaan2 terkait perkrutan dan janji-janjinya terhadap nasabah (red). “tambahnya”.
Bahkan saat itu kita simpulkan untuk klarifikasi resmi ke pusat namun bukan memberikan klarifikasi tetapi membalas dengan surat pemberitahuan dari PT.Narada atas pengembalian uang “D” senilai 1.5 milyar dengan sistem bertahap Rp.850jt dibulan Agustus 2021, dan sekaligus nasabah “D” menjadi urutan pertama dalam pengembalian uang dari salah satu nasabah lainnya. Akan tetapi kita komitmen untuk pengembalian sekaligus, dan atau meminta penjelasan secara tertulis, dan lagi-lagi NAM mengulur janji dengan meminta “D” untuk pengisian formulir Redemption sebagai bagian syarat pengembalian sekaligus tanpa diberikan formulir. Sehingga jelang beberapa waktu kemudian dengan komunikasi rutin tim kita dengan pak Daniel akhirnya Narada pusat mengirim formulir tersebut untuk diisi dan dikirimkan via email narada pusat “sambungnya”
Lagi-lagi menurut kita dalil atau alasan yang menurut kita hanya mengulur waktu, kami menerima pemberitahuan untuk tidak mengisi formulir Redemption tersebut, tetapi mengikuti rapat bersama melalui zoom metting, sehingga saat itu lagi kita mendapatkan dalil dan alasan pengembalian utuh setelah rapat pimpinan pusat. Dan rapat zoom metting tersebut di pimpin oleh perwakilan PT Narada yaitu pak Budi, dan beliau menjajikan segera memberikan kabar setelah rapat.
Beberapa waktu pak Budi memberikan informasi hasil rapat pimpinan pusat kepada saya atas dipastikannya pengembalian uang “D” di bulan Desember 2021 dengan sebesar Rp.500jt, sehingga saya kaget dan memintanya untuk memastikan tanggal, hari pengembalian tersebut beserta alasannya. Namun tidak juga ada kabar balasan apapun, sehingga dugaan kuat kita semakin mengarah kepada perbuatan melawan hukum. Sehingga dikarenakan tidak ada kabar jadwal pembayaran akhirnya kita sampaikan lewat surat resmi namun tidak di jawab, kita loss kontak dengan pak Budi hingga bulan 12 juga berlalu dan meninggalkan tahun 2021.
Atas beberapa hal yang patut kita duga kuat sebagai Perbuatan Melawan Hukum (PMH) akhirnya kita sepakat membentuk tim baru, dan menggugat PT.Narada Aset Menejemen melalui Advokat kita, termasuk mempertanyakan kinerja Otoritas Jasa Keuangan (OJK) selaku regulator dan pengawas terhadap aset menejemen tersebut, bahkan OJK termasuk tergugat dalam perkara ini mengingat tidak terpisahkan dari peran yang di embannya. Sehingga begitu mudahnya oknum yang kita duga kuat telah melakukan tindakan melawan hukum atas investasi atau uang nasabah yang kita maksud.
Kantor Hukum Andi Lawyer & Partners selaku kuasa hukum litigasi nasabah NAM tersebut mengungkapkan saat dikonfirmasi menjelaskan bahwa: Narada Aset Manajemen sebagai Manajer Investasi wajib segera bertanggung jawab atas kerugian yang disebabkan penyelenggaraan yang tidak profesional n bertentangan dengan peraturan perundangan yang berlaku sehingga janji imbal hasil atau profit tidak terealisasi.”tegasnya”
Bahkan jangankan imbal hasil yang dijanjikan justeru modal awal investasi milik klien kami tidak bisa dikembalikan padahal seharusnya modal awal yang berbentuk unit penyertaan itu bisa klien kami cairkan kapan pun klien kami mau.. Karena berada pada bank penyimpanan atau Bank Kustodian..berdasarkan bukti bukti yang kami dapatkan terbukti PT. Narada Aset Indonesia ingkar janji atas apa yang telah dijanjikan terkait keuntungan bagi klien kami..Atas dasar itu kami mengambil langkah mengajukan gugatan perdata untuk menjaminkan hak hak klien kami atas dana penyertaan Reksadana nya pada Narada manajemen dapat kembali utuh dan mendapatkan keadilan sesuai peraturan perundangan yang berlaku, tutupnya.
Hingga berita ini di rilis oleh beberapa portal berita nasional sebelumnya mencoba menghubungi pihak Narada Aset Menejemen, terutama bapak Daniel Mok yang sebelumnya mengaku pimpinan Narada di wilayah Riau.
